1. Definitions
  1. In these general terms and conditions, hereinafter referred to as: “General Terms and Conditions”, the following definitions apply:
  2. SimonSport, trading under the name: “Simon Tennisschool VOF, based in Rosmalen”, hereinafter referred to as “SimonSport”.
  3. “Client”: the natural person or legal entity that enters into the Agreement with SimonSport.
  4. “Participant”: the natural person who, pursuant to the Agreement between SimonSport and the Client, makes use of the services of SimonSport in the capacity of participant.
  5. “Agreement”: an agreement between SimonSport and the Client regarding one or more services to be provided by SimonSport for the benefit of the Client and the Participant.
  6. “Registration form”: the form that is part of the brochure and the website “https://www.simonsport.nl” of SimonSport.
2. Applicability
  1. General Terms and Conditions apply to all offers, order confirmations, and resulting or related agreements or further agreements made by SimonSport, unless expressly excluded.
  2. The applicability of any general (or specific) terms and conditions or stipulations of the Client is expressly rejected by SimonSport.
  3. Deviations from or additions to the Agreement or the General Terms and Conditions in any form whatsoever shall only apply if SimonSport has expressly agreed to them.
  4. In the event of a conflict between the provisions of the General Terms and Conditions and/or provisions of the Agreement, the latter shall prevail.
  5. “Registration form”: the form that is part of the brochure and the website “https://www.simonsport.nl” of SimonSport.
3. Payment
  1. Payment for a SimonSport Sports Camp must be made within 14 days of receiving the final confirmation from SimonSport, provided you have not already paid.
  2. For bookings made from June 1st of any calendar year, payment must be made within 7 days of receiving the final booking confirmation.
  3. From July 1st, you must pay immediately after registration via iDEAL. The camp dates listed on the site are confirmed.
  4. Registration for a SimonSport Sports Camp creates a payment obligation.
  5. If you cancel, the payment obligation remains in effect.
4. Discount
  1. Discount codes cannot be exchanged for cash.
  2. Discount codes cannot be combined.
5. Rules
  1. The participant is required to follow all reasonable instructions from SimonSport to ensure the proper execution of the Agreement. Safety and treating each other with respect are the foundations for fully enjoying the sports and activities offered. SimonSport expects these to be observed during the stay at the accommodations provided under the Agreement.
  2. Any participant who causes or may cause nuisance or disturbance, to such an extent that the proper execution of the Agreement by SimonSport is significantly hindered, may be excluded from the camp by SimonSport.
  3. The participant agrees that photos/videos taken during the camp by SimonSport staff, in which the participant is recognizable, may be used for promotional purposes.
6. Liability of SimonSPORT
  1. All luggage and other personal belongings remain at the Participant's own risk at all times. Except in cases of damage caused by intent or gross negligence by SimonSport, SimonSport accepts no liability for damage to (valuable) items, luggage, and other personal belongings of the Participant—whether or not entrusted to the care of SimonSport staff—as a result of theft, loss, or damage.
  2. Except in cases of transport provided directly by SimonSport, or in cases of intent or gross negligence by SimonSport, SimonSport accepts no liability for the transport of the Participant. In such cases, the Participant must contact the relevant carrier. Upon request by the Participant/Client, SimonSport will provide the name of the relevant carrier.
7. Force majeure/changes/cancellation by SimonSPORT
  1. SimonSport reserves the right to cancel a camp or day camp in the event of insufficient registrations and offer the participant an alternative week. This will be done no later than 30 days before the start of the camp week.
  2. If there are insufficient registrations for a specific camp (football, tennis, or hockey), SimonSport may decide to combine the camps into a multi-sport camp. This will cover all sports, with continued focus on the sport originally registered for, and will include plenty of individual attention during training.
  3. You will need to take out your own insurance for cancellation coverage.
8. Lost and found
  1. Lost property will be kept for 2 weeks after the end of a camp week. During this period, lost items can be collected at the camp location. After this period has expired, SimonSport is entitled to donate these items to charity.
9. Applicable law and disputes
  1. The Agreement and all agreements resulting from it are exclusively governed by Dutch law.
  2. All disputes that may arise from the Agreement or agreements resulting from it between the parties will be settled by the competent court in 's-Hertogenbosch.
General terms and conditions for giveaways
  1. Giveaways are organized by SimonSPORT.
  2. Participation in promotions is free of charge.
  3. Participation occurs when you have commented on SimonSPORT social media.
  4. One entry per person.
  5. Employees of SimonSPORT are excluded from participation.
  6. The duration of promotions and the date of the winner announcement are always stated in the social media post.
  7. SimonSPORT reserves the right to amend the terms and conditions of promotions at any time or to terminate promotions without providing a reason.
  8. The winner of a promotion is selected through an impartial draw.
  9. The winner of a promotion will be notified personally via the social media channel where the promotion took place. If an email address has been provided, the winner will be notified by email.
  10. If the winner does not come forward within one week of the announcement, a new winner will be selected.
  11. SimonSPORT reserves the right to exclude individuals from participation if there is a suspicion of unlawful participation or fraud.
  12. If a participant is already registered for a weekly camp, they may participate in a different week.
  13. It is not possible to apply the value of a won weekly camp to an existing registration for a weekly camp.
  14. Participants who do not win a prize will not be notified.
  15. The weekly camp prize cannot be exchanged for another product or a cash equivalent.
