1. Registration procedure and tuition fees
  1. Participation in the training sessions is only possible after registration via SimonTENNIS.nl, SimonPADEL.nl, Yourpadel.nl, or Yourtennis.nl.
  2. Registrations that do not include agreement to these terms and conditions will not be processed.
  3. Participation in training sessions is at your own risk.
  4. You may withdraw up to 4 weeks before the start of the course, with the exception of locations where the lesson schedule is finalized earlier. Once the lesson day and time have been confirmed, you can no longer withdraw. Withdrawals within the specified period must be made in writing via email, stating the reason. If you withdraw after this deadline, you are required to pay the tuition fees.
  5. If a student discontinues the training sessions mid-course, tuition fees will not be refunded.
  6. By signing the registration form, you enter into a payment obligation, even if you do not exercise your right to participate in the course. If the registrant cannot be scheduled on the provided available days/times, there is no payment obligation, unless an alternative day/time has been agreed upon verbally or in writing with the student.
  7. Once payment, whether partial or full, has been made and the lesson time and day have been scheduled according to the provided availability or subsequently agreed upon, no refunds of any kind will be issued if the course is not attended.
  8. Refunds of tuition fees are not possible in the event of illness, injury, relocation, or other causes that fall within the student's sphere of risk.
  9. Students must have paid the tuition fee via iDEAL no later than 1 week after the first lesson has taken place. At locations where payment is only possible via direct debit, the tuition fee will be collected starting 1 week after the start of the course.
  10. If payment is not made on time via the iDEAL payment option as intended in art. 1.8, a reminder will follow. With the second reminder (from 2 weeks after the start of the course), an amount of €7.50 in administrative costs will be charged on top of the tuition fee, and with the third reminder, €15.00 (from 4 weeks after the start of the course). After this, the file will be handed over to a collection agency. You may also be denied access to the course.
  11. At a number of locations, you can participate in lessons as a non-member. In that case, an additional surcharge will be charged, with the exception of the 'Introduction to Tennis/Padel' course. This applies if you are not yet a member 2 weeks before the start of the course. If a lesson participant decides to become a member of the relevant location after this date, he/she is no longer entitled to a refund of the additional amount, unless otherwise agreed with the association. Information regarding participating in lessons as a non-member can be found on the website.
  12. Students in the Introduction to Tennis or Padel course will receive their racket during the 1st lesson. For students who join after the course registration closing date, the racket will be sent for a handling and shipping fee of €9.00.
  13. When you are placed in an incomplete group, SimonTENNIS/PADEL may adjust the number of lessons pro-rata without consultation. Should we choose to increase the amount, this will be done in consultation.
  14. Registration is only possible after the student or parent/guardian has created a personal "My SimonTENNIS/PADEL" account. The responsibility for entering/maintaining account details regarding changes in training level (playing strength), home address, mobile number, and email address lies with the customer. Financial consequences resulting from missing or incomplete data are at the customer's expense.
  15. The right to participate in a SimonTENNIS/PADEL course only arises after receipt of the course fee or an irrevocable direct debit authorization for the course fee.
  16. In the event of late payment, (the remainder of) the total amount will be immediately due and payable.
  17. When joining the 'Introduction to Tennis' course at a later date, the lesson participant is not entitled to a free tennis racket if a partial invoice is issued.
  18. Juniors are those who have not yet reached the age of 18 by January 1st of the lesson year.
2. The training sessions
  1. The lesson duration is indicated during registration for the lesson program. A lesson duration can be 25, 30, 50, 60, or 90 minutes (including warm-up or practice time).
  2. To give as many club members as possible the chance to take lessons, in times of high demand, it may be decided to offer shorter lessons (e.g., 60 minutes instead of 90 minutes). The number of lessons will remain the same. Naturally, the tuition fee will be adjusted accordingly.
  3. In the event that few students have registered for a lesson day, it may be decided to extend the duration of a training session (e.g., 90 minutes instead of 60 minutes). In consultation, it may then be decided to reduce the number of lessons (course duration). This allows us to organize more working hours for the available trainer on the same day/evening.
  4. In the event that fewer or no trainers are available on a lesson day, it may be decided (without prior consultation) to hold lessons in larger groups. This is to ensure as many students/members as possible can still be accommodated. If no trainer is available on a specific day/time, students may be placed on a different day in consultation.
  5. The grouping of lesson groups by level and the appointment or assignment of a teacher is reserved for the management of SimonTENNIS/PADEL.
  6. If lessons are missed due to your own actions, they cannot be made up.
  7. When participating in outdoor lessons, there is no 100% guarantee that lessons will always proceed due to weather conditions and court playability. Lessons will go ahead unless the trainer notifies you via the app groups or otherwise, or if Simon sends an email via the cancellation button. Lessons may be cancelled (due to weather conditions) in the following situations: 1. A (local) code red has been issued. 2. The courts are unplayable due to puddles, snow, or freezing (slippery conditions) and are therefore not safe enough. 3. The club/location decides to close the park. Furthermore, tennis courts may also be unplayable (no ball bounce) during a thaw. The club often makes this decision itself, which we as an organization must follow.
  8. If lessons cannot take place due to the circumstances mentioned above, they will in principle be made up 1-on-1 within the scheduled lesson period (including a maximum of 3 scheduled make-up weeks or lessons, applicable to 16-18 lesson courses) on the same day and time after the final lesson. For courses of 8-12 lessons, a maximum of 2 make-up weeks or lessons will be scheduled on the same day and time after the originally scheduled final lesson. For courses of fewer than 8 lessons, a maximum of 1 make-up week or lesson will be scheduled. One theory lesson or fitness training session may be used in situations as described above.
  9. Lessons cancelled because no substitute is available for an absent trainer due to illness, injury, or other reasons will be 100% made up. Cancelled lessons that cannot be scheduled on the same day/time within that lesson period will be made up on other days or weekends/school holidays. In this case, the trainer determines when these lessons are scheduled, and no 100% guarantee can be given to students that they will be able to attend the paid number of lessons. In the event of significant cancellations (force majeure) that jeopardize a subsequent course, SimonTENNIS/PADEL may decide to provide make-up lessons in the form of a clinic(s). These may also be scheduled on weekends during the course.
  10. In principle, no lessons are given on Sundays, official public holidays (Easter Monday, Ascension Day, Whit Monday, Christmas Day, Boxing Day, New Year's Day), and during primary school holidays. An exception to this is the May holiday (2 weeks), during which lessons will continue for 1 week. Deviations from this may occur per location and in the following cases:
    a. Sunday is scheduled as a lesson day at the location.
    b. Lessons were cancelled due to bad weather, unplayable courts, or the teacher's absence (illness, injury, or other reasons), and this jeopardizes the start of the subsequent course.
    c. If lessons were cancelled due to government-mandated measures.
  11. Lessons that have already started will never be made up. Lessons cancelled due to a teacher's illness/absence will always be made up.
  12. We are currently no longer dealing with a pandemic. Should similar situations arise in the future, SimonTENNIS/PADEL reserves the right to adjust group sizes if the government imposes restrictions regarding the maximum group size per court/instructor for tennis and padel lessons. Lessons may then be held on multiple courts, provided the club in question makes multiple courts available. If not, it may not be possible for the entire group to have lessons at the same time. Compensation for this is that lessons will be held in a smaller group (more personal attention per person). This may mean that the student receives less lesson time per course, without any financial compensation being offered to the students.
  13. Before the start of the course, the trainer will create a group chat with all students. The SimonTennis/Padel mobile number will also be added to this group. You cannot send messages to this number. It is used by us only in case of emergencies (if a trainer is unexpectedly unable to inform the students themselves) and for promotional activities.
3. Liability
  1. SimonTENNIS/PADEL and its associated trainers are not liable to students for personal accidents and any resulting damages, nor for theft or damage to students' property, or injuries sustained during training sessions.
  2. The website has been compiled with the greatest possible care, and SimonTENNIS/PADEL strives to provide accurate and up-to-date information. No rights can be derived from the information on this website. If you have any questions about the content of the website, please contact us. SimonTENNIS/PADEL accepts no liability for damages related to the information on this website or the temporary inability to access this website. SimonTENNIS/PADEL is not responsible for the content of websites linked to or from this website.
4. Discount
  1. By agreeing to the general terms and conditions, the student consents to the processing of their personal data in accordance with the purpose for which it was provided.
  2. By agreeing to the general terms and conditions, the parent of the (minor) student consents to the processing of their personal data in accordance with the purpose for which it was provided.
